Who runs this site
This site is run by Austen Diamond Creative Services LLC, a Utah limited liability company doing business as Austen Diamond Photography, Austen Diamond Wedding Photography, and Austen Diamond Commercial Photography + Film. These terms cover austendiamondphotography.com and austendiamond.com. “We” and “us” mean the company.
What the site is for
The site is a portfolio and a way to get in touch. Sending the contact form is an inquiry, not a booking. Nothing is reserved until an agreement is signed and the retainer is paid. By sending the contact form or emailing us, you agree that we may email you about your inquiry and, from time to time, about our availability, news, and offers, and every such email has a way to unsubscribe.
Your agreement controls
Every engagement with us is governed by the written agreement you sign. If anything here conflicts with that agreement, the agreement controls.
Our photographs, video, and copy
Every photograph, video, piece of writing, and design element on this site is our copyright, or is used with permission. You may look at it, share a link to it, and show it to the people you are planning with. You may not copy, download, screenshot for reuse, scrape, frame, or reproduce any of it without our written permission. If you are a client, your agreement governs your use of your own images.
You may not use this site, or any image, video, or text on it, to train, fine tune, develop, or evaluate an artificial intelligence or machine learning model, or to build a dataset, whether by hand or by automated means. That includes crawlers and bots acting for that purpose. Written permission is the only exception.
Client images and people in them
Client images appear on the site under the agreement that client signed. If you appear in an image on this site and want it removed, our Privacy Policy explains how to ask, and we will take it down within a reasonable time.
Reviews
The reviews on this site are individual clients’ own experiences, republished in full or as excerpts and lightly corrected for spelling, punctuation, and grammar. Your experience will be your own.
Links
Links to venues, vendors, platforms, and other sites are there for convenience. We do not control those sites and are not responsible for what is on them.
The site itself
We keep the site current and working, but we make no promise that it will be free of errors or interruptions, or that every detail on it is up to date at the moment you read it. Prices, collections, and availability are set in your quote and agreement, not on a web page.
Liability for using the site
To the extent Utah law allows, we are not liable for any loss that comes from using or relying on this site, except for fraud or any liability the law does not allow us to limit.
Which law applies
These terms are governed by the law of Utah. Any dispute about the site is brought in the state or federal courts located in Salt Lake County, Utah.
Changes
When we change these terms we will update the date at the top and post the new version here. The terms posted at the time you use the site are the ones that apply.
